This app is provided to you as an end user in its current form. By using the app, you accept the following terms:

• Subject matter: Use of the app for private, non-commercial purposes.
• Scope of services: Functionality as described in the App Store; no entitlement to specific availability or feature additions.
• User obligations: No misuse, no unlawful content.
• Fees: Unless otherwise stated, free of charge; in-app purchases optional.
• Duration/Termination: Use can be terminated at any time by uninstalling.
• Minimum age: Use of the app requires a minimum age of 13 years. Persons under 13 may only use the app with the consent and under the supervision of a parent or legal guardian.

By purchasing a subscription, you do not acquire an app, software or other goods, but a license to use the premium features of this app. The license is generally non-transferable, with the following exceptions:

• Family subscriptions can be shared with family members through Apple Family Sharing.
• Lifetime licenses are permanently tied to your Apple ID.

Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Renewal occurs at the same price and for the same duration as the original subscription.

Cancellation

Subscriptions can only be cancelled through the App Store Settings:

• Open the Settings app on your iPhone/iPad
• Tap your name (Apple ID)
• Select Subscriptions
• Select RecipeStash and then Cancel Subscription

Cancellation within the app is not technically possible. After cancellation, premium access remains until the end of the paid period.

After termination of a time-limited subscription, access to premium features expires; basic features remain usable.

According to applicable law (in particular DDG/DSA), we are responsible for our own content. There is no general obligation to monitor third-party content; obligations to remove/block unlawful content remain in place.

Links to external third-party websites are provided without guarantee for their content; upon becoming aware of legal violations, we will remove such links immediately.

Content created by the operator is subject to applicable copyright law. Reproduction or distribution beyond the limits of copyright law requires prior written consent.

User Responsibility

The user is solely responsible for all content they import, enter, or share in the app – including recipes, texts, images, and other data.

The user warrants that they have all necessary rights (in particular copyrights, usage rights, personality rights) to this content or have obtained appropriate permissions.

Disclaimer for Imported Recipes

The app provides the ability to import recipes from external sources (websites, social media, PDF files, photos, manual text entry). During import, recipe data is automatically recognized and structured. The operator assumes no responsibility or warranty for:

• The accuracy, completeness, or timeliness of imported recipe content (ingredients, quantities, preparation steps, nutritional information).
• The safety or tolerability of ingredients listed in imported recipes. Imported recipes may contain allergens or incompatible substances that are not specifically identified or labeled.
• The compliance with food safety regulations or hygienic standards in imported recipes (e.g., internal cooking temperatures, cooking times, storage instructions).
• The accuracy of automatically recognized data during import (e.g., erroneous OCR recognition, incorrectly assigned quantities, missing ingredients).

The user is obligated to independently verify imported recipes for accuracy and completeness before use – particularly with regard to allergens, intolerances, and food safety.

No Nutritional or Health Advice

The recipes and nutritional information presented in the app are for informational purposes only and do not constitute medical, nutritional, or dietary advice. If you have allergies, intolerances, health conditions, or special dietary requirements, please consult a physician or qualified nutritionist.

Indemnification

The operator assumes no liability for legal violations through user-generated or imported content. Upon becoming aware of legal violations, corresponding content will be removed. The user agrees to indemnify and hold harmless the operator from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to content posted, imported, or shared by the user.

AI-Based Recipe Recognition

The app offers an optional premium feature ("AI Scan") that uses artificial intelligence to recognize recipes from photos. This feature uses the Google Gemini API (Gemini Flash Vision), an AI service operated by Google Ireland Limited.

When using this feature, a compressed photo is sent via a Firebase Cloud Function to the Gemini API. The AI model analyzes the image and returns a structured recipe (name, ingredients, instructions).

Notice Regarding AI-Generated Content

• Recognized recipes are automatically generated by AI and may contain errors (e.g., incorrect quantities, missing ingredients, incomplete instructions).
• The user is obligated to independently verify AI-recognized recipes for accuracy before use.
• The operator assumes no responsibility for the accuracy, completeness, or safety of AI-generated recipe content.

AI-Estimated Nutritional Values

The app offers the option to have nutritional values for recipes estimated by AI. This estimation is triggered exclusively by an explicit user action. Only recipe-related data (recipe name, ingredients, servings, language) is sent to the Google Gemini API – no personal data. The estimated nutritional values can optionally be automatically transferred to Apple Health (iOS) or Google Health Connect (Android).

All AI-estimated nutritional values are non-binding approximations. They are intended for general guidance only and do not replace professional nutritional advice or laboratory analysis. The operator assumes no responsibility or warranty for the accuracy, completeness, or reliability of these estimated values.

The user is obligated to independently verify AI-estimated nutritional values before use – particularly in case of allergies, intolerances, metabolic conditions, or special dietary requirements.

Usage Limits (Rate Limits)

For security reasons and to protect against misuse, AI-powered features (recipe recognition, nutrition estimation) are subject to usage limits (rate limits). The number of requests per user per day is limited. Once the limit is reached, further requests will be temporarily rejected.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the app will be error-free, uninterrupted, or available at all times, or that defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE APP – INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM INACCURATE RECIPE INFORMATION, DATA LOSS, OR BUSINESS INTERRUPTION.

Under German law: In cases of intent and gross negligence, we are liable without limitation; in cases of simple negligence, only for material contractual obligations (cardinal obligations), limited to typical, foreseeable damage.

The above limitations of liability shall not apply to the extent they are excluded or restricted by mandatory law of the user's jurisdiction.

These terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the user has their habitual residence shall remain unaffected.

The exclusive place of jurisdiction, to the extent permitted by law, is Kaiserslautern, Germany. For consumers within the EU, the statutory place of jurisdiction shall apply.

All product and company names are trademarks or registered trademarks of their respective owners. Apple, iOS, and App Store are trademarks of Apple Inc.

If any provision of these legal terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the economic purpose of the invalid provision.
